The Perfect Recipe for the Start-Up HOA Budget

Be sure to allocate proper funds to your reserve fund and aim for a funding level ranging from 70-100% to cover expected needs down the road.

 

HOA Governing Documents: Retain the services of an Attorney familiar with the DRE process and setting up HOA’s.  They will prepare the governing documents, including the Declaration of Covenants, Conditions, and Restrictions (CC&Rs), Bylaws, and Articles of Incorporation.

Easement, Maintenance, & Delayed Conveyance Agreements: If you’re considering pushing amenities out or your assessments are too high in the initial phases, discuss these documents with your attorney and see if you’re eligible to use them. These agreements are between the HOA and the Subdivider, providing rights to use the common areas. They delay turning over the common areas until a later date and make dues marketable. Your attorney is responsible for securing these documents for you and submitting them to the DRE for approval.
